HeX Group (Hygiene & EXPERTISEEXPERTISE SPRL) invites all users to read the legal notice and general terms and conditions for using the website, hex-group.eu, carefully. By accessing, browsing or using the website, users confirm that they have read, understood and accept the general terms and conditions for using the website.

ARTICLE 1. LEGAL INFORMATION

By virtue of articles 78 and 80 of the Belgian Companies Code, the obligatory wording within the context of its publication is included in this article.

The publishing directors of the website are Mr Tony Wattrelot and Mr David Deneuville, in their capacity as managers of their management company, themselves managers of the company Hygiene & Expertise SPRL.

The HEX-GROUP.EU website is hosted by OVH SAS, whose registered office is at 2 rue Kellermann 59100 Roubaix (France).

ARTICLE 2. ABOUT THE WEBSITE

The purpose of the HEX-GROUP.EU website is:

  • To present the group and its Control, Calibration, Lab, Inspection, Distribution and Consultancy activities;
  • To establish a relationship with the company;
  • To provide analysis, testing, calibration and inspection reports via the customer area.

ARTICLE 4. ACCEPTANCE OF THE TERMS AND CONDITIONS

Access to and use of the website are subject to acceptance of and respect for these general Terms and Conditions (T&C).

The publisher reserves the right to edit the website and services, as well as these T&C, at any time and without notice, including in particular to adapt them to changes to the website by providing new functions or removing or changing existing functions.

Users are therefore advised to refer to the latest version of the T&C, available on the website at any time, before using the website. If users disagree with the T&C, they should not use the website.

ARTICLE 5. ACCESS AND BROWSING

The publisher uses technical solutions available to it to allow access to the website 24 hours a day, 7 days a week. It may nevertheless suspend, limit or interrupt access to the website or to certain pages at any time in order to implement updates, changes to content or any other measure deemed necessary for the smooth running of the website.

If users sign in to and browse the HEX-GROUP.EU website, this implies full acceptance of these Terms and Conditions, regardless of the technical means and devices used.

Access to the hex-group.eu website is free of charge. The cost of accessing and using the telecommunications network is the user’s responsibility, in accordance with the conditions stipulated by the telecommunication suppliers and operators.

These T&C apply to any version or extension of the website on social media networks and/or communities that exist now or in the future.

Users are reminded that fraudulently entering or staying in an IT system, hampering or distorting the functioning of such a system, or fraudulently entering or editing information in an IT system constitutes a crime punishable by criminal sanctions.

ARTICLE 6. MANAGEMENT OF THE WEBSITE

For the proper management of the website, the publisher may at any time:

  • Suspend, interrupt or limit access to all or part of the website, or reserve access to the website, or to certain parts of the website, to a specific category of users;
  • Delete any information that might impede how it works or that breaches any national or international laws, or the rules of Netiquette;
  • Suspend the website in order to implement updates.

ARTICLE 7. SERVICES RESERVED FOR REGISTERED USERS

1. REGISTRATION

Access to certain services requires the user to register.

Registration for and access to the website’s services are exclusively reserved for customers and partners of the company Hygiene & Expertise SPRL. Anybody who would like access is invited to send a request by email to info@hex-group.eu.

When they register, users undertake to provide accurate, truthful and up-to-date information about themselves and their personal information. Users must also check their data regularly to make sure it is still accurate.

Users must therefore provide a valid email address, to which the website will send confirmation of registration for the services. One email address cannot be used more than once to register for the services.

Any communication from Hygiene & Expertise SPRL and its partners is therefore deemed to have been received and read by the user. As a result, the latter undertakes to check messages received by this email address regularly, and to respond within a reasonable time if necessary.

An individual can only register for the website’s services once.

Users will be assigned a username with which to access their area (hereinafter referred to as “Customer Area”), as well as entering their password.

The username cannot be changed, but the password can be changed online by the user in the Customer Area. The password is personal and confidential, so the user undertakes not to disclose it to third parties.

In any case, Hygiene & Expertise SPRL reserves the right to refuse a request for registration for the services if the user does not respect the provisions of these Terms and Conditions.

2. READING REPORTS

In order to read signed PDF reports, users need to download the latest version of the Acrobat Reader software. This software can only be downloaded from a website other than that of Hygiene & Expertise SPRL. On this other site, users are invited to fill in a questionnaire about their personal details. If they do not want to give their name and address, they should go directly to step 2 to download the software free of charge.

3. UNSUBSCRIBING

Registered users will be able to ask to unsubscribe at any time by sending an email to info@hex-group.eu. Any request to unsubscribe will be effective within ten working days.

4. DELETION OF THE CUSTOMER AREA BY THE WEBSITE

The user’s attention is drawn to the fact that the publisher reserves the right to delete the Customer Area for any User who breaches these terms and conditions, and more specifically in the following circumstances:

  • If the user uses the website illegally;
  • If, when creating the Customer Area, the user knowingly sends incorrect information to the website;
  • If the user is not active on their Customer Area for at least one year.

If the publisher decides to delete the user’s Customer Area for one of these reasons, this will not constitute a loss for the user whose account has been deleted.

This deletion will not constitute a waiver of the publisher’s right to take legal action against a user who has breached these rules.

ARTICLE 8. RESPONSIBILITIES

The publisher is only responsible for the content that it has published itself.

The publisher is not responsible:

  • In the event of technical, computer or compatibility problems or failures of the website with any equipment or software whatsoever;
  • For direct or indirect, tangible or intangible, foreseeable or unforeseeable damages resulting from the use of or difficulties using the website or its services;
  • For intrinsic features of the Internet, including in particular those relating to a lack of reliability or insecure information found on it;
  • For illegal content or activities using its website, without its knowledge.

Furthermore, the website cannot guarantee the accuracy, completeness and topicality of the information published therein, which has no contractual value apart from signed PDF reports published in the Customer Area.

Users are responsible:

  • For protecting their equipment and data;
  • For their use of the website or its services;
  • For a failure to respect the letter or the spirit of these T&C.

ARTICLE 9. HYPERTEXT LINKS

The website might contain hypertext links to other websites over which Hygiene & Expertise SPRL has no control. Despite prior and regular checks carried out by the publisher, the latter does not accept any responsibility for the content that might be found on these websites.

The publisher authorises the insertion of hypertext links to any page or document on its website as long as they are not inserted for commercial or advertising purposes.

Furthermore, the website’s publisher must be informed in advance before any hypertext links are inserted.

This authorisation does not include websites disseminating information that is illegal, violent, polemical, pornographic or xenophobic or that might offend the general public.

Lastly, Hygiene & Expertise SPRL reserves the right to have a hypertext link to its website deleted at any time, if the website feels that it does not comply with its editorial policy.

ARTICLE 10: CONFIDENTIALITY

As well as these Terms and Conditions, the website has a confidentiality policy that describes how personal data is processed when users visit the website, as well as how cookies are used.

By browsing the website, users declare that they are also aware of the abovementioned confidentiality policy.

ARTICLE 11. INTELLECTUAL PROPERTY

The way the website is structured as well as the text, graphics, photographs, sounds, videos and computer applications of which it is composed belong to the publisher and are protected as such by the laws in force relating to intellectual property.

As an exception, certain pieces of content (text, images etc.) belong to their respective owners. They are used by Hygiene & Expertise SPRL with the authorisation of the owners of the rights applying to this content.

The trademarks of the website’s publisher and those of its partners as well as the logos appearing on the website are registered trademarks.

Any representation, reproduction, adaptation or use, in full or in part, of the content, registered trademarks and services proposed by the website, via any process whatsoever, without the specific prior written authorisation of the publisher, is strictly prohibited and might constitute an infringement by virtue of the law of 30 June 1994 on copyright and neighbouring rights. Elements explicitly identified as copyright-free on the website are excluded from this.

Access to the website does not constitute recognition of a right and, in general, does not grant any intellectual property right to any element of the website, which will remain the exclusive property of its author.

ARTICLE 12. APPLICABLE LAW AND COMPETENT JURISDICTION

These Terms and Conditions are governed by Belgian law. If there is a dispute, and no amicable agreement can be found, the dispute will be referred to the Belgian courts in accordance with the jurisdiction rules in force.

Any translation of these Terms and Conditions, into English or Dutch, is provided to the user solely for their convenience. If there are any inconsistencies or contradictions between the French version and its translation, the French version shall prevail.
